General Statement
Hummingbird Communications Ltd. is committed to providing its customers with Connectivity Software that is "Year 2000 Compliant". Year 2000 Compliant means that neither performance nor functionality is affected by dates prior to, during and after the Year 2000. Hummingbird Connectivity Products have no inherent dependencies on date/time and therefore will continue to be compliant with all valid date and time combinations as supported by the underlying operations systems/hardware.

Applicable Products and Versions
This statement applies to the following Hummingbird Connectivity Software for the Windows 3.x, Windows 95, Windows 98, Windows NT 3.51 and 4.0-Intel and Alpha platforms and IBM OS/2 operating systems:

Exceed Product line

• Exceed: Version 5.1.3 and greater
• Exceed OS/2: Version 3.0 and greater
• Exceed 3D: Version 5.1.3 and greater
• Exceed XDK: Version 5.1.3 and greater
• Exceed XDK OS/2: Version 3.0 and greater

NFS Maestro Product line

• NFS Maestro Client: Version 5.1.3 and greater
• NFS Maestro Solo: Version 5.1.3 and greater
• NFS Maestro Server: Version 5.1.3 and greater
• NFS Maestro Gateway: Version 6.0.1 and greater

HostExplorer

• HostExplorer: Version 4.0 and greater

Handling Non-Compliance
In the unlikely event that an issue of Year 2000 Non-Compliance is discovered, the customer must promptly notify Hummingbird Communications Ltd. and provide reasonable assistance identifying and remedying the non-compliance. Hummingbird Communications Ltd. reserves the right to implement remedies in the then current versions of the products only. This may require the customer to upgrade their software to achieve compliance.
